The case is based on research conducted in June 2020 which established that a third of Uganda’s adult population has not yet received National Identity Cards and is therefore being left behind from benefiting from developmental programs and other services.
The Electoral Commission wants the notice of appeal struck out with costs on grounds that Kidandala after filing the notice, did not file a memorandum of appeal which is supposed to state to the court the reasons as to why he is challenging the decision.
The Justices have thus set aside the High Court decision and awarded Kananura costs of the suit in a judgement read by the Court of Appeal Registrar Susan Kanyange.
In her statement issued on Saturday, Langa Siu, says “the latest appointments are mostly intended to address staffing gaps in the magisterial areas especially in view of the anticipated election-related petitions with strict timelines.”
“….We act on behalf of Mr. Kyagulanyi Robert Ssentamu on whose instructions we address you as follows; Our client has instructed us to file the above presidential election petition on his behalf. Although the deadline for filing is Monday 1st, February 2021, we wish to file the petition Saturday the 30th day of January 2021 by 2 pm to avoid any eventuality,” reads the letter in part.
