David Abala Appeals Against Ngora Election Petition Ruling Court of Appeal 2

Abala says that Justice Okuo erred in law and fact when she held that the wrongful declaration of Achayo did not affect the result of the election in a substantial manner and that she misdirected herself of the law of the Illiterate’s Protection Act Cap. 78, thereby arriving at an erroneous decision where she expunged 23 affidavits filed by Abala.

The lawyers also argued that while the witnesses claimed to be illiterate, some were able to read and write and also comprehend English, which is the official language of court.
