The panel of the constitutional court is comprised of the Deputy Chief Justice, Alfonso Owiny-Dollo and Justices Egonda Ntende, Hellen Obura and Ezekiel Muhanguzi. He adjourned court to September 19th when the hearing will start hearing the matter that has been pending for the last eight years.
Ssebuufu also known as Eddie Mutwe was charged before Gulu grade One Magistrate Yunus Ndiwalana. He was charged together with Musa Ssenyange alias Rabadaba Musisi, a 31-year-old driver a resident in Njeru Town Council in Buikwe district.
Through his lawyers of M/S Nakachwa and Co Advocates, Bakaleke argues that it is an abuse of discretion for the DPP and against public interest to institute charges against him without sufficient and crucial evidence on file. The lawyers also argue that they have proof that the police file, which the DPP is using, doesnt have statements of the victims on how matters unfolded.
