Dissatisfied with the decision, Nabadda through her lawyers of Okalang Law Chambers has filed an appeal before the Court of Appeal in Kampala citing eight grounds.
Delivering his verdict on Tuesday, Justice Musa Ssekaana noted that the petitioner failed to provide substantial evidence to prove the allegations against Asiimwe.
“We received the affidavit for the petitioner and having had a thorough perusal, we realized that they were in contempt of the court order. They have substantially amended, the affidavit introducing issues that were never in the original affidavit,” said Denis Atwijukire one of Ssenyonyi’s lawyers.
In her ruling, lady Justice Ketra Katunguuka cited inconsistencies in Nandagire’s academic papers and eventual nomination. She overturned her victory on grounds that she did not qualify for election as a member of parliament.
Lumolo’s Lawyer Hassan Kamba contested the judgement, saying some evidence disappeared from the court records. As a result, Lumolo and her team have filed a notice of appeal before Mbale High court.
“This court having found that the first respondent is the only daughter of Peter Wamala Kisiro with the names of Nambozo Florence Wamala who has Advanced Academic qualifications, it hereby confirms that the said Nambozo Florence Wamala is validly elected as the Woman Member of Parliament for Sironko District,” he said.
Nalubega ran to court challenging Kinyamatama’s nomination by the Electoral Commission on grounds that she was not a registered voter anywhere in Uganda, which disqualifies her from being nominated and subsequent election for any elective position.
