Through his lawyer Pace Advocates, Migadde says that he had gone to fuel his motorbike at a Pump Station when he was picked up by soldiers for allegedly wearing a red t-shirt resembling those used by People Power activists led Bobi Wine and handed over to the errant officers.
Bakaleke through his lawyer Sarah Nakachwa on October 2nd 2018 filed an application where he wanted court to proceed in the absence of the Attorney General the respondent because he had not filed submissions to show that he was interested in the main case which also seeks to block the fraud trial.
The Principal State Attorney Lino Anguzo said that the lawyers of the applicant erred in law when a civil related application was served to the DPP. He advised that the DPP be struck off from the case and the case be instituted against the Attorney General of Uganda.
Through his lawyers of M/S Nakachwa and Co Advocates, Bakaleke argues that it is an abuse of discretion for the DPP and against public interest to institute charges against him without sufficient and crucial evidence on file. The lawyers also argue that they have proof that the police file, which the DPP is using, doesnt have statements of the victims on how matters unfolded.

The first order for their court appearance was issued three weeks ago, based on two applications filed in court by Agnes Ajambo, a wife to John Kasera and another by Stephen Mangeni, a brother to Pamba Wilberforce Oguti and a friend to Peter Onyango and Frederick Wabwire.
