According to the story, Kipoi was arrested for overstaying his visit making him a prohibited immigrant. Uganda Radio Network has learnt that Kipoi travelled to Botswana upon his release from custody in Uganda and has been in detention since October 15th, 2020.
Delivering her ruling on Monday, Justice Jane Francis Aboddo of Criminal Division of High Court said that the High Court has no powers to grant Kipoi bail since he is being tried by the Military Court Martial. She advised Kipoi to apply for bail in the Court Martial.
Gen Gutti asked Iduli the number of times he has petitioned High Court and the Constitutional Court Challenging Kipois trial in the Court Martial and lost. In his response, Iduli said all he needs is an impartial and an independent trial.
In his affidavit, Col. Busingye explained that the charges against Kipoi were instituted by his office contrary to claims by the applicants that they came from the DPP. Col Busingye also argued that the General Court Martial has original jurisdictions just like High Court, saying Kipoi was legally charged before the army court.
According to Muhumuza, he was surprised by the questions and asked Kipoi why he was asking him such questions. Kipoi reportedly replied that M23 was comprised of Ugandans and Rwandese who would be difficult to deal with as they plot to overthrow government.
