The judge explained that the said items would be marked and identified until the witnesses who recovered them came forward to testify and tender them as exhibits. "It, therefore, follows that a chain or evidence has to be followed before the exhibits are admitted right from the time of recovery to the tendering," said Muwata.
Juliet Harty Hatanga, the ICD Deputy Registrar told Uganda Radio Network Monday that despite Justice Gaswaga's new role at the African Court, he will continue sitting on the panel in the trial of Kwoyelo until the case is concluded.
Molly Katanga is the sole defendant facing a murder charge stemming from the incident on November 2, 2023, along Mbuya Chwa 2 Road in Nakawa Division, Kampala District. During his testimony, Dr. Muhwezi stated that he found no physical injuries on Amanyire and Otai and certified their mental health as stable.
Represented by lawyers MacDusman Kabega, John Jet Tumwebaze, and Elison Karuhanga, the accused persons presented their sureties, many of whom were close relatives engaged in various businesses. In his judgment delivered this afternoon, Justice Moses Kazibwe noted that although the defense lawyers tried to convince court that Bagyenda suffered a disease of mind by the time he committed the crime, both prosecution witnesses including Dr. Santos Ojara and Defense witnesses like Dr Brian Mutamba and Sister. Jane Francis Nantamu agreed that depression is not a permanent condition.
