The DPP has since taken over previous cases Mabirizi levied against Kyagulanyi which are scattered in Kampala and Wakiso Courts and have since stalled after the various government departments' delay to provide him with supporting documents as evidence.
According to the Government of Kenya, the rules of the East African Court state that a document may be expunged from the court record if for stance it may prejudice or delay the fair trial, is an abuse of court process or is scandalous; But to them, Mabirizi doesn't show how he will be prejudiced if their defense is maintained on the court record.
Mabirizi now wants a permanent injuction prohibiting any Uganda Government official from implementing or acting on the strength of the Cabinet decision requiring every motor vehicle to be fitted with tracking devices at owners cost on grounds of being unconstitutional.
In his letter dated June 10 2021, Ssekaana notes that Mabirizi filed a case against the Attorney General and the same was brought to his attention by the Deputy Registrar of the court out of concern that it was the third similar matter filed by him in a space of two weeks.
This is not the first time Mabirizi is complaining about the invasion of parliament by the army. In 2018 after the passing of the Constitutional Amendment Bill, 2018 that removed the age limitations from the Constitution, Mabirizi petitioned national and international courts over the invasion of Special Forces Command that saw a number of MPs being beaten and others injured.
Mabirizi in documents filed before the Civil Division wants an injunction restraining the Commission from proceeding with the process undertaken and decisions it has reached in shortlisting, interviewing, appointing and recommending to the President for appointment of applicants for Judicial Officers.
Evidence submitted by the Kenyan Government shows that Uganda was charging Kenya poultry meat Value Added Tax of 18 percent and withholding tax of six percent which is not applied to locally produced like foods, one percent of infrastructure levy, six percent of withholding tax on processed chicken meat and six percent tax for broilers and layer day old-chicks
The proceedings were instituted by lawyer Male Mabirizi on Monday arising from Owiny-Dollo's conduct on March 18th and 19th 2021 when he allegedly showed disrespect, obstruction and disturbance in the course of judicial proceedings to Lady Justice Esther Kisakye.
Justice Owiny-Dollo argued that if Mabirizi had sought to discover his moral competence, he would have found out that he previously took instructions from a wide range of clients whom he didn’t bond with while exercising his profession as a lawyer.
Mabirizi argues that the ban on the importation of goods from EAC partner states is unlawful and infringement on the fundamental and operational principles of the community, which among others encourages free movement of goods, transparency, democracy and rule of law, accountability and equitable distribution of benefits.
The lenders under their umbrella, Money Lenders Union Limited together with their Secretary General Male Mabirizi have filed their case before the Kampala Sub Registry of the East African Court of Justice.
In her September 24th, 2020 letter, Kaitesi says the file is required to help the High Court to review the proceedings that resulted into the Magistrate's decision of allowing the Directorate of Public Prosecution to take over the criminal proceedings that were initially instituted by Male Mabirizi by way of private prosecution.
In a letter dated September 2 2020, written by the Buganda Road Court Resident State Attorney Janet Kitimbo on behalf of the DPP notes that the law mandates them to take over all the criminal proceedings in the country.
