In their ruling read by the Court of Appeal Registrar, Lillian Bucyana, the court of appeal judges faulted the High court for entertaining Katushabe’s petition on grounds that it was filed late. They argued that Katushabe should have filed a complaint with the Electoral Commission during the nomination process.

During the January 14th, 2021 polls Masaba polled 9415 votes against 9854 votes garnered by his rival, Seth Kizangi Massa Wambede. Masaba lost with a margin of 954 votes. He petitioned Mbale High court accusing Masaba of falsifying the results from Makosi Trading Center polling station in Bukonde and ballot stuffing.polling station.

High Court Dismisses Petition Seeking to Block Nomination of Lwengo Woman MP Court of Appeal 2

In her ruling, Justice Nakintu, concurred with Namujju’s defence team, saying the controversy on the names of Namujju's academci documents was determined in a case filed by Nkonge’s supporter, Paul Sserwanga before Masaka High Court in 2016 and later the Court of Appeal where it was dismissed.
