Samuel Azama, the uncle of the deceased, demands that the prison authorities hand over the warders involved in the alleged torture to the police for prosecution. He expressed the family's and community's distress over the delayed arrest of the suspects.
"We have not feared protests," Prisons spokesman Frank Baine told URN. "But we have taken precautions to protect and secure offenders. Even if you have guns, you don't walk to the lions saying 'I will shoot you!' Avoiding conflicts is much better."
There are currently 266 prisons in the country, which are collectively keeping 76,432 inmates, far above the holding capacity of 21, 000 inmates, according to Prison Spokesperson Frank Baine. Most of these are criminal cases as seen in the Judiciary's Annual Performance Report released in October 2023.
The Court has heard that Mabirizi is most likely to die in the Maximum Security Prison if at all his prayer is not granted because he feels his right to life is being threatened.
“Every July, we submit the names we deem fit for pardon and it is the discretion of the committee to look through and forward them for the presidential pardon or sit on the list and the year passes without the pardon,” said Baine.
In his suit, Rubarema contends that around February 2018 while on duty the three Prison Warders led inmates to dig on a private farm in Kayunga District, whose owner the torture victim doesn’t remember. This is according to the information Rubarema received from Tendo when he visited him in Luzira prisons in October 24th, 2019.
