Kiggundu through his lawyers of Muwema and Company advocates argue that the June 13th 2023 judgement was defective and unconstitutional as it contravenes severe articles of the Constitution which provide for the right to fair hearing, supremacy of the constitution , equality and freedom from discrimination and other human rights.
Tuesday’s unanimous decision by five justices who include the Chief Justice Alfonse Owiny-Dollo, Lady Justices, Faith Mwondha, Percy Night Tuhaise, Justice Mike Chibita, and Stephen Musota arise from a series of legal proceedings initiated by Kiggundu and his two companies against Diamond Trust Bank (DTB) Uganda and DTB Kenya.
It is alleged that Mudhasi had conspired with lawyers Akleo Mugisha and Martha Orishaba, and the RAM Engineering Company Director Julius Mugambagye to defraud Makerere University of 3.5 billion shillings among other allegations.
