Peter Amalo, the State prosecutor argued that although the convict is a first-time offender, the events leading to the death show that the Ario betrayed the deceased's trust and he should be punished for taking someone's life.
According to the prosecution, Amuja grabbed Ocen's arm and twisted it before punching and kicking him severally on the back and stomach respectively. He took all the money from Ocen's pockets before fleeing the scene. Ocen died shortly after the incident.
In his ruling on Friday, Justice Vincent Emmy Mugabo dismissed the petition on grounds that Engola did not prove that any illegality or offences were committed in the election by Odur or the Electoral Commission.
