The Minister received the iron sheets acquired due to the loss of public property, an offence under Section 10 (1) of the Anti-Corruption Act 2009 as amended -Prosecution
The order was issued this morning by Justice Jane Okuo Kajuga following a successful application by the lawyers representing Karamoja Affairs Minister Mary Gorreti Kitutu, her brother Michael Naboya Kitutu and her Personal Assistant Joshua Abaho with whom she is jointly charged.
The Prosecution alleges that in June 2022, at the office of the Prime Minister's Stores in Namanve and Kkola Cell Bulwanyi Parish, Mukono District, Nandutu was involved in dealing with government property, specifically 2,000 pre-painted iron sheets of Gauge 28.
Abala says that Justice Okuo erred in law and fact when she held that the wrongful declaration of Achayo did not affect the result of the election in a substantial manner and that she misdirected herself of the law of the Illiterate’s Protection Act Cap. 78, thereby arriving at an erroneous decision where she expunged 23 affidavits filed by Abala.
The court found that there were four different results for the two candidates leading to the confusion.
Achayo was first declared winner of the Ngora County elections with 9,517 votes. Abala who had garnered 9,226 votes was instead declared winner by the Electoral Commission in Kampala.
