Court heard that the University has all the facilities to teach the course and during the 3rd, 4th and 5th years, the students do clinicals in Mulago hospital, Kiruddu Hospital and Kawempe Hospital together with students from Makerere University. Further , that during these clinicals, the students are taught by the same staff at these hospitals and some of the Medical Council staff have taught the students of King Ceasor University throughout this period of five years.
"The right to a hearing may be excluded if prompt action is required by the administration in the interest of public safety, public health, or public morality, or more broadly in the public interest. The hearing may delay administrative action, defeating the very purpose of taking action in specific situations. The applicant was justifiably suspended indefinitely without a hearing due to the nature of the alleged offense of breaching school rules and regulations,” ruled Justice Ssekaana.
Byarugaba, who was succeeded by his former Deputy Patrick Ayota, argues that the decision to reject the board's recommendation to reappoint him was procedurally incorrect and violated his legitimate expectations by not affording him a fair hearing.
In his judgement, Judgement Justice Ssekaana indicated that the Libyan Embassy in its Diplomatic Note dated November 24th, 2020 confirmed to the bank and the Ministry of Foreign Affairs that the legal representative of the organization is Saleh Salim Al-Fakri in his capacity as Chairman of the Steering Committee and AbdelSalam A. Ali as the Country Director and Financial Controler as the lawful signatories to the organisation bank account.
