Sironko Woman MP Election: Asha Mafabi Lumolo Files Notice of Appeal

Lumolo’s Lawyer Hassan Kamba contested the judgement, saying some evidence disappeared from the court records. As a result, Lumolo and her team have filed a notice of appeal before Mbale High court.

Asha Mafabi Lumolo, the former Sironko district woman parliamentary candidate has filed a notice of appeal challenging the verdict by Justice David Matovu upholding the victory of her rival, Florence Nambozo.    

Lumolo contested and lost to Nambozo in the January 14th, 2021 polls. She rejected the poll results citing electoral malpractices and voter bribery. She also claimed that Nambozo lacks the minimum academic qualifications for election as a member of parliament. 

   

However, on Tuesday morning, Justice Matovu upheld Nambozo’s victory, saying that she was duly elected Sironko Woman Member of Parliament. He also noted that Nambozo obtained the Uganda Advanced Certificate of Education and was validly elected. 

“This court having found that the first respondent is the only daughter of Peter Wamala Kisiro with the names of Nambozo Florence Wamala who has Advanced Academic qualifications, it hereby confirms that the said Nambozo Florence Wamala is validly elected as the Woman Member of Parliament for Sironko District,” he said.

However, Lumolo’s Lawyer Hassan Kamba contested the judgement, saying some evidence disappeared from the court records. As a result, Lumolo and her team have filed a notice of appeal before Mbale High court. 

“Take Notice that the petitioner/intended appellant being dissatisfied with the judgement of his lordship Justice Matovu David delivered on 28th September 2021 in the above-mentioned petition intends to appeal against the entire decision and orders of the judge in the said matter,” reads the notice of appeal. 

Kamba told URN shortly after the ruling that there was foul play since some of the evidence disappeared from the court records.

According to Kamba, the judge failed in his role because he only decided to rely only Nambozo’s brother who could also not prove that she went to school as she insisted.
