Arua Treason Case Investigations Stall

It emerged on Thursday that investigations into the case have stalled. Officials from the Criminal Investigations Department say the investigations hit a snag after finding out that multiple exhibits seized from the suspects have sophisticated passwords of their owners.

Investigations into the Arua treason case have hit a snag.

It emerged on Thursday that investigations into the case have stalled after detectives from the Criminal Investigations Department said that the multiple exhibits seized from the suspects have sophisticated passwords of the owners. 

They told Court in Gulu that the Police Forensic Unit and the Cyber Crimes Department are all stuck with exhibits which include 20 Mobile Phones and IPAD Computers seized on August 13th, the day of the chaos ahead of the Arua Municipality by-election.

In addition to the phones, four vehicles have been marked as exhibits at Arua Central Police Station.

Hebert Wanyoto, the West Nile Regional in Charge of Crimes Intelligence and Investigations in West Nile Region asked court to compel the suspects to reveal their passwords to the police for the investigations to be completed. 

Wanyoto said some of the suspects used their thumbprints as passwords making it hard for Police to access their interior systems.

In January, Court summoned the officers in charge of Crimes and Intelligence in Gulu and Arua to explain the status of the exhibits and why personal properties belonging to the accused had not been returned to them. 

Ronald Were, the former Gulu OC CIID and Davis Lusambo, the Arua OC CIID appeared in court alongside Wanyoto.

Lusambo, the Arua OC CIID officer told court that majority of the suspects had collected some of their personal properties from Police. He submitted partial lists of suspects who have picked their properties. 

Lusambo says Police is now left with four vehicles registration number UAP 064 R (Grader), Toyota Tundra Pick Up UAT 416 K, Toyota Land Cruiser UAN 207 A and Toyota Kruger UAU 918 N. The others he said is a Pistol registration number D-4627 licensed to Arua Municipality Member of Parliament Kassiano Ezati Wadri. He says the damaged vehicles were impounded and abandoned at the scene of crimes. 

Tony Kitara, a lawyer for the suspects says they are unhappy with the manner the Directorate of Criminal Investigations is handling the investigations. He says there is overwhelming evidence that the investigations have grossly violated the fundamental human rights of the suspects

Kitara says Court will decide whether to refer the matter to Constitutional Court or commit it to High Court for trial on July 4th.

MP Robert Kyagulanyi, the Kyadondo East Member of Parliament says the manner in which the investigations have been handled has reduced the treason case into a political persecution.

Kyagulanyi says it is ridiculous for the Directorate of Criminal Investigations to ask for their passwords when it is known that their phones have been used to call their close associates.

Julius Ocen, a State Attorney said that despite the setbacks, the treason case file has been sent to the Directorate of Public Prosecutions for sanctioning. He says it delayed to be forwarded to the DPP pending arrest, charging and addition of Mityana Municipality Member of Parliament Francis Zaake onto the list of suspects.

Zaake was charged for alleged offences of escape from lawful custody and treason early this month. He becomes the 36th suspect charged with treason in connection with the chaos which happened ahead of the Arua Municipality by-election.  Court presided by Gulu Grade I magistrate Isaac Imran Kintu set July 04th to rule on whether to refer the matter to Constitutional Court or not. 

Last week, three victims of the Arua Municipality parliamentary by-election violence sued Government and Jonathan Musinguzi, the former West Nile Region Police Commander for torture.   

They are Night Asara, Shaban Atiku and Jane Abola, a member of the Central Executive Committee of Forum for Democratic Change-FDC party.
