Bad black moved to the Anti-corruption High court challenging the decision by the Chief Magistrates court to deny her bail twice. Through her lawyer, Caleb Alaka, Black argued that her two-year old baby was sick and needed her attention. She had brought six witnesses to court but the judge punched holes in their submissions.
Justice Paul Mugamba asked all the sureties to return with titles of property since the matter at hand was not simple. After holding a 20 minute talk with the lawyers in his chambers, Alaka was forced to withdraw the sureties citing the lack of documents showing property owned. Alaka asked for an adjournment to enable his client look for sureties willing to deposit property documents in court.
Justice Mugamba noted that this was not a simple matter in which sureties deposit passports and bring LC letters. He noted that the amount involved in this matter is a lot saying the accused needs at least three substantial sureties before being granted bail.
Black is accused of embezzling 3.8 million dollars belonging to Daveshan Development Company, a real estate company.
Prosecution alleges that between September 2010 and May 2011 at Kampala, Bad Black and other suspects still at large embezzled $ 3.8 million from her employer Daveshan Development Company. It is believed that Bad Black used her position as a co-director in the company to embezzle the funds. Her co-director David Green Halgh accused her of embezzlement, a matter that was later picked up by the Director of Public Prosecutions.
She denied the charges and her attempts to apply for bail were blocked twice in the Chief Magistrates court. Bad Black has been on remand for nearly one month. She returns to court on Monday 14th November for the hearing of her bail application.
