Court has finally pronounced itself on the long standing feud between the family of the late Nyansio Kasibante Mukudde and trustees over their father’s estate. Mukudde’s children led by Deo Mawejje have been embroiled in a wrangle with the trustees over their family land at Misaali village Nyendo-Ssenyange division.

The children are Deo Mawejje, Catherine Nankya, Annet Nankya, Norah Nalugooti, Priscicah Bukirwa, Maria Namagembe and Mukudde’s heir Richard Kityo. The trustees are Simon Lutakome and Cyprian Bwanika, the former Mayor Masaka Municipality. The conflict between the two parties started after the trustees allegedly sold off several acres of Mukudde’s family land to private developers and evicted his children from their family house in Nyendo leaving them stranded.

As a result, the children dragged the trustees to court. Through their lawyer Fred Mukasa Mbidde, the children protested their eviction and demanded to take possession of their family land since they had grown up. Mbidde told court that the trustees had illegally evicted the children from their ancestral land. He also argued that Cyprian Bwanika, one of the trustees was never consulted before the children were evicted.

Mbidde told court that Bwanika, who has been bedridden for over seven years, is no longer capable of overseeing Mukudde’s estate and therefore should be replaced. In her ruling this afternoon, Mary Ikit, the Masaka Chief Magistrate concurred with Mbidde. She ordered Mukudde’s children to return to their home and family land. She also said the trustees must be reconstituted since the current team is incompetent.

Ikit argued that since Bwanika, one of the trustees is incapacitated; he cannot over the estate of the deceased. Simon Lutakome who was not in court has not yet responded. Mbidde couldn’t hide his excitement with the ruling saying he was also happy that court has ordered Lutakome to file an account of all the monies he has been getting from the property.

Cue out: …by the executors.”//

Deo Lutakome and Catherine Nankya, both children of the late Mukudde say they are extremely happy to be back home following the ruling. Lutakome says they are planning to convene and discuss how they will repossess their property that was sold off.

Part of the property was bought off by Kasagazi Kansaze, a witch doctor who has set up a shrine on the land and David Wanzala of River of Life Church who bought three acres of land.
