Court Throws Out Election Petition Against Kagoma County MP

 Justice Joseph Murangira has thrown out a petition challenging the election of the Kagoma county Member of Parliament, Moses Walyomu. The National Resistance Movement-NRM party candidate Fredrick Munyirwa dragged Walyomu to court citing electoral malpractice including voter bribery.  

He also accused Walyomu, who garnered 7,948 votes against his 5,048 votes and lack of the requisite academic documents warranting him to contest as MP. The petitioner claimed that the legislator’s true names are Moses Muwanika and Walyomu Moses Muwanika.

 

However, in his ruling delivered on Monday, Justice Murangira that the petitioner failed to substantiate his claims, which warranted the dismissal of the same with costs. 

Walyomu’s lawyer, Ben Ssemanda told URN that his client complied with all the legal requirements while changing his name in 2009, adding that there was no need for the petitioner to sue him over the same. 

He also claimed that during cross-examination, the petitioner’s witnesses were inconsistent, which forced the court to expunge their testimony from the court records.

Munyirwa says that the judgement was characterized with bias and unfairness, saying that the court did not consider most of his evidence despite being essential in strengthening the grounds raised in his petition.  

He revealed to URN that he has instructed his lawyers to appeal the judgement.
