Family Wants Kabarole Lands Officers Interdicted Over Criminal Charges

According to court documents seen by our reporter, it is alleged that the duo between February 2016 and October 2019 while at Fort Portal in Kabarole district forged minutes of Kabarole district Land Board Meeting KDLB MIN 06/02/2016 purportedly held on February 9, 2016.

The children of the late Hussein Juma have petitioned the Kabarole Chief Administrative Officer to interdict two officers in the district lands office on grounds that they are facing criminal charges. The affected officers are Peter Alinda the Land Management Officer and Cypriano Rwaheeru, the Chairperson of Kabarole District Land Board.

However, URN has since established that Rwaheeru ceased to be the Land board chairperson. In a January 3, 2023 letter, the petitioners accuse the duo of holding onto office in contravention of the public service standing orders, which require public officers facing criminal charges to step to pave way for smooth proceedings.

The Public Service Regulations Cap 29 (i)  states that “Where a responsible officer considers that the public interest requires that a public officer ceases to exercise the powers and functions of his or her office, he or she shall interdict the officer from exercising those powers and functions, if proceedings for his or her dismissal are being taken or are about to be taken or if criminal proceedings are being instituted against him or her.  Alinda and Rwaheeru were in  February 2021 charged before the Fort Portal Chief Magistrates’ Court for alleged forgery and uttering false documents.

According to court documents seen by our reporter, it is alleged that the duo between February 2016 and October 2019 while at Fort Portal in Kabarole district forged minutes of Kabarole district Land Board Meeting KDLB MIN 06/02/2016 purportedly held on February 9, 2016. The forged documents were reportedly used by Beatrice Nyindombi to forge a transfer form for land comprised in the lease register of volume 1222 folio 06, plot 107 block 45 at Harugongo in  Kabarole district.

Nyindombi is battling a land dispute with Hussein Juma in the civil Division of the High Court. Hussein alleges that Nyindombi forged a land title to read FRV HQT 838 Folio 21 Block 45 Plot 7 instead of the correct title registered as LVR 1222 Folio 6 plot 7 Harugongo Burahya Block 45.

Nyindombi was the wife of Dr. Josephat Njuguna Karanja, who was the vice president of Kenya between 1988 and 1989, during the reign of President, Daniel Arap Moi. When contacted about the petition, Martin Anthony Lukwago, the Kabarole Chief Administrative officer said that since he is still new in the office and needs to investigate the matter to find out exactly what happened.

He acknowledged receipt of the petition to interdict the implicated officers but wondered why his predecessor didn't take action. He, however, says that he cannot act on the petition because has never received court documents about the charges.
