Former Minister Asks Court to Order MTN to Produce Rival's Phone Records

The former Member of Parliament Bughendera County, Bundibugyo District has asked the court to compel telecom company MTN-Uganda to produce the phone records of his rival Moses Kiiza Acrobat.   

Kibanzanga, who was also the Minister of Veterans, lost to Kiiza in the January 14th 2021 elections. Kiiza got 13,897 votes while Kibanzanga 13,462.

He accuses Kiiza of using his phone to commit several electoral offences before and during the elections.

Through his lawyers Alfred Makasi, he wants the call log of Kiiza’s known telephone numbers for the period December 2020 to January 15 2021.

Makasi told the court presided over by Lady Justice Jeanne Rwakakooko that the Kiiza made calls while at places where electoral offences were committed.

Man Kibanzanga had also asked the court to compel the electoral commission-EC to produce Biometric data of the voters but this application was challenged by the Principle legal officer for the commission, Enoch Kugonza who informed the court that the machines are supposed to be cleaned after six months from use.

On the call log, Enock Wahindo, Kiiza’s lawyer objected to the application saying it’s unconstitutional and deprives their client’s right to privacy.  Court further heard that producing such data could put the safety of those he was communicating with at risk of being attacked by supporters of his rival.

Justice Rwakakooko fixed August 24 when she will make a ruling on the application.
