Former State House Aide Loses Threatening Violence Case Against Husband

Buganda Road Magistrate's Court has acquitted Samwiri Lugudde for allegedly threatening to shoot former state house aide Dr Elizabeth Nabatanzi, his estranged wife.

Samwiiri Lugudde had been accused of threatening to kill Dr Nabatanzi Lugudde at Buganda Road Court premises on 21 April 2011 when he allegedly threw a bottle of water and also attempted to grab her.

To that effect her husband to whom they got married in 1973; was charged with threatening violence, a case that he has been battling with for the past three years.

But presiding Grade One Magistrate Sanyu Mukasa; held that prosecution had failed to prove the case beyond reasonable doubt on grounds that the two crucial ingredients of proving threatening violence; intention to intimidate and threatening to injure were not proved.

The magistrate added and observed that the couple had their own inner grudges.

“The two crucial ingredients which include intention to intimidate and threatening to injure have not been proved by prosecution. It is evident from the testimonies of that both accused and complainant to have their inner grudges. The accused had earlier filed an impersonation case against his wife who in turn also filed a case against him. The   existence of grudges weakens the prosecution evidence,” she said.

She said: “Evidence against the suspect may have been fabricated therefore; I hereby acquit the accused of charges of threatening violence against his wife.”

Prosecution alleged that on April 27, 2011 at Buganda Road Court in Central Division in Kampala, with intent to intimidate or annoy his wife, Samwiiri Lugudde threatened to injure or shoot her. He denied the charges
