High Court Declares Akena\'s Presidency Illegal

High Court has declared the presidency of Jimmy Akena, the embattled Uganda People\'s Congress Party president illegal. Justice Yasin Nyanzi made the ruling this evening saying the UPC party Electoral Commission didn\'t have the powers to declare Akena UPC president since the delegate\'s conference, which elected him wasn\'t properly constituted.

The ruling was in response to an application filed by Joseph Bossa, the UPC vice President under the Olara Otunnu administration and two others, challenging Akena\'s presidency. The petitioners rushed to the High Court Civil Division on June 17th shortly after Akena was controversially declared UPC party president.

Court will hear on a similar petition by other UPC party members challenging Akena\'s presidency on December 21st 2015. Early this week, Justice Nyanzi extended Akena\'s presidency for two weeks after postponing the hearing due to the failure by the rival UPC leadership led by Dr. Olara Otunnu to show up in court citing the ongoing campaigns.

In September, Otunnu\'s led UPC administration petitioned High court seeking a permanent injunction restraining Akena from unlawfully occupying the various party positions including that of the president. The group also wants High Court to order the eviction of Akena and his cabinet from the 6th floor of Uganda House, the UPC party headquarters and declare that he was not elected UPC president, in accordance with the party constitution.

 

Others sued alongside Akena include his wife Betty Amongi, Maxwell Ebong Patrick Akora, Fred Ebil, all MPs and Patrick Mwondha and Edward Seggany. Court records show that UPC conducted its presidential nomination exercise on May 30, 2015. Otunnu\'s group claims that contrary to the normal procedures for processing any electoral results, a group of about 30 UPC members allied to Akena led by his wife, besieged Uganda House for an overnight and took over the preliminary returns.

Otunnu further alleges that Akena\'s faction then stormed the boardroom of the UPC headquarters and harangued the Party Electoral Commissioners before demanding that Akena be declared the sole winner of the May 30 party primaries.
