The High Court in Mbarara has stopped the Uganda Investment Authority-UIA from evicting the occupants of Mbarara Industrial park. The acting Mbarara High Court Assistant Registrar, Samuel Twakyire issued the orders following an application filed by eight occupants in Mbarara Industrial park the last month for a Judicial Review.
The occupants are Millionstars Health Products Limited, Whitesky 256-SMC limited, Bold Energy Limited, Premium Paints and Chemical Products Limited, Esperenza Distributors limited, Active Living Uganda Limited, Bontao (U) limited, and Agribusiness and Real Estate Investments.
They ran to the High court after the Uganda Investment Authority leased/Sub Leased the 13-acres of land to the Mbarara Gatsby Small Scale Industries Association. In their petition, the applicants argued that as sitting tenants in Mbarara Industrial Park, they ought to have been given the first chance to lease the land.
They faulted Uganda Investment Authority for leasing the land to Mbarara Gatsby small scale Enterprises Association (MGSSA), a non-legal entity. Their lawyer Gabriel K Byamugisha, said that Mbarara Gatsby small scale Enterprises Association had issued letters threatening to evict his clients from the industrial Park.
He asked the court to issue a temporary injunction stopping the eviction pending the disposal of their application for judicial review. In his ruling, Twakyire restrained UIA or its agents from evicting the Applicants or closing/locking their business until the final determination of the substantive application.
Byamugisha says that after securing the interim order, they now await the July 4th, 2022 hearing of their application for judicial review.

Uganda Investment Authority was represented by Amiina Nasak. Last year, Uganda Investment Authority handed over the industrial park to Mbarara Gatsby Small Scale Enterprise Association Limited.
