Land Probe Summons Businessman Over Mukono Evictions

The Commissions Lead Counsel Ebert Byenkya explains that the commission has received two complaints against Banoba. One was filed by the family of the late Ham Mukasa questioning the land title in his possession and another by the evictees who accuse him of wrongfully evicting them from their land.

The Commission of Inquiry into Land Matters has summoned businessman Dick Kihangire Banoba over evictions in Nama Sub County, Mukono District.

According to the Commission's Lead Counsel Ebert Byenkya, Banoba is expected before the probe team on Wednesday, October 24, to respond to reports that he evicted over 30 families from a 488-acre piece of land.

Byenkya explains that the commission has received two complaints against Banoba. One was filed by the family of the late Ham Mukasa questioning the land title in his possession and another by the evictees who accuse him of wrongfully evicting them from their land.

Appearing before the Commission today, the Chairman of Mukono Bibanja Holders' Association Hosea Ssonko, a victim of the eviction said that they have been paying ground rent to Ham Mukasa's heir James Mukasa until Banoba appeared and claimed ownership of the land and later asked them to vacate.

Ssonko accused Banoba of using the courts, the police and Attorney General's office in Mukono to carry out atrocities against them. He told the commission that Banoba had him jailed on fictitious charges in 1996 and forcefully put his land on public auction claiming that he had failed to compensate him in a case Ssonko says he was not a party to.

The 2012 case involved 12 occupants who Banoba accused of damaging property and court demanded that the accused compensate him on top of vacating the land. Byenkya observed irregularities in court orders and procedures, like exaggerated compensation amounts, which Ssonko alluded to saying it was a means to kick out occupants of that land.

According to the Commission, Banoba says he bought the land from Dr Emmanuel Lumu, Uganda's first Health Minister. Byenkya noted that the commission is to establish the issue of double ownership of title to the land as claimed by both Banoba and the family of the late Ham Mukasa.

He ruled out questioning Dr Lumu on grounds that he might be less helpful due to his advanced age and inability to comprehend issues.  Dr Lumu made 102 years in March.
