The Otuke Grade One magistrate court has referred the case in which, Milton Odongo, the Lira Resident District Commissioner is accused of impersonation and uttering false documents, to the Directorate of Public Prosecution.

Odongo is being accused by another person, Milton Odongo, a teacher at Omwonylee Primary School in Otuke District of using his academic papers both for Primary and Uganda Certificate of Education, O'level certificate.

On Wednesday while presiding over the case filed by the teacher under Private prosecution, Benjamin Serwango, the Otuke District Grade One Magistrate says Odongo, the teacher did not follow the legal procedures in reporting or filing his criminal case against RDC Odongo.

He advised Odongo (teacher) who appeared before the court without his lawyers to go to police and record fresh statements in regard to his allegation and present all his academic papers to the DPP for verification and comparison with the one which RDC Odongo is currently using.

Serwango says the matter must be properly investigated by the DPP before it is filed in the court for proceeding.

Odongo declined to comment on the court decision saying he will further consult his lawyers.

Emmanuel Egaro of Egaro and Company Advocate, the lawyer representing RDC Odongo described the allegation as baselessly raised with intent to malice his client.

Egaro welcomes the court ruling and guidance to have the case and allegations fully investigated by the DPP.

According to Odongo, the teacher, RDC Odongo, who is also known as Okwany Aguti obtained his Primary seven and Uganda Certificate of Education-UCE certificates in 1988 and 1996 respectively.

“I can confirm that Okwany Aguto who is holding the office of the Resident District Commissioner of Lira is using my academic papers bearing my name Milton Odongo and is now threatening me with criminal prosecution as well as threatening my life,” Odongo’s affidavit reads in part.

When Odongo was dragged to court, he had instituted a case of defamation against the teacher at Lira CPS.
