Henry Luke Orombi, the Archbishop of Church of Uganda has asked court to dismiss with costs a suite filed by Christians in Kinkizi blocking the consecration of Rev. Can. Bernard Bagaba, as the diocesan bishop.
Bishop Orombi says that the nomination and election of Rev. Can Bagaba by the House of Bishops was done in line with the constitution of Kinkiizi diocese and the church of Uganda constitution.
Bishop Orombi was responding to allegations made by the Christians in their case against him, Rev. Can Bagaba and the outgoing Bishop John Ntengyereize, whom they accuse of influencing Bagaba's nominations yet he ceased to have authority over the diocese.
In their suite, the Christians allege that Rev. Can. Bagaba was unconstitutionally elected Bishop to replace Ntegyereize following his request to retire on 9th May 2010.
They claim that Bagaba\'s election was conducted by a nomination committee instead of an electoral college.
But Bishop Orombi in his defense says that nominations committee that selected Can Enos Komunda and Bagaba for consideration by the house of bishops was constituted by the synod of the diocese of Kinkiizi in line with the constitution of church of Uganda.
He says that on December 19, 2009 the House of Bishops sat and duly considered and elected Rev. Can Bagaba as the bishop elect for Kinkiizi diocese in accordance with provisions of the provincial constitution.
The Rev. Can. Bagaba's election has been marred in controversy after he was accused of infidelity.
However, the House of Bishops cleared him after he was exonerated by a DNA test of allegations of fathering two children out of wedlock.
Annette Tugumisiriza, a maid had alleged that the senior cleric was the father of her two children.
The church subsequently commissioned a DNA test, which was carried out in South Africa.
