PPDA Freezes of Mbarara City North Division Bank Account

The Public Procurement and Disposal of Public Assets Authority -PPDA Tribunal has ordered for the freezing of the Mbarara City North Division Account in Housing Finance Bank.

The order arises from a debtor  judgment between Mbarara City and MBJ Technologies Limited as the 1st and 2nd respondents respectively and Housing Finance bank limited as the Garnishee that was filed before the PPDA Appeals Tribunal at Kampala by Obon &Infrastructure development Jv.

Through their counsel of Ajju, Baleese, Bazirake Advocates in a letter addressed to the legal department of Housing Finance bank limited Obon &Infrastructure development Jv wants the bank to freeze account number 0500128496 in the names of Mbarara City North Division Collections.

According to the Order, the tribunal directs that the account with the amount of 47,415,980 Uganda Shillings belonging to Mbarara City North Division be attached.

The tribunal also directs that due to the mentioned order to the Mbarara City also the 1st respondent be attached until he answers to the decree issued by the tribunal dated 18th October 2021.

The tribunal also orders that the said respondent or Garnishee Housing Finance Bank Limited appears before the registrar of the tribunal on the 4th of November 2021 at 11:00 AM to show cause why the said Garnishee should not pay the debt from them to the said judgement creditor.

John Behangana Matama, the Mbarara City Clerk confirms that the account has been attached and no withdraw is supposed to be done by the division until they pay the money being demanded from the city.

Behagana says that the order arises from a court case filed by the applicants who were among the bidders who applied to be consultant supervisor for the contract with Multiplex to construct roads in Mbarara City.

He says the applicant did not win but went to court and two weeks ago court decided that they put aside the contract.

Benon Kyabweisho the Mbarara City North Division Chairperson says that attaching their account is an error noting that their account is independent and they appear nowhere in the cases.

Behagana says their lawyers have already started on the matter and are ready to appear in court as required.
